COVID-19 Testing Plan

Senate Bill 1479, which goes into effect January 1, 2023 and remains in effect until January 1, 2026, requires each local educational agency, defined to mean a school district, county office of education, or charter school to create a COVID-19 testing plan or adopt the California Department of Public Health’s (CDPH) framework. The bill requires each local educational agency to publish the testing plan on its internet website.

Safe Return to In-Person Instruction Plan

The U.S. Department of Education (ED) published Interim Final Requirements (IFR) on April 22, 2021 requiring Local Educational Agencies (LEAs) receiving ESSER III funds to submit an LEA Plan for the Safe Return to In-Person Instruction and Continuity of Services.

LEAs which did not have a statutorily compliant plan in place as of March 11, 2021, must create and post this plan within 30 days of completing their ESSER III Assurances.

Until September 2023, all plans must be reviewed, and, as appropriate, revised, at least every six months to incorporate new or revised CDC guidance and other changed factors.
